Terms and Conditions for Money Transfer from the United Kingdom

  1. I understand that Payment Instrument issued cannot be cancelled without prior approval of payment bank in recipient country. No Liability will be accepted for variances or delays due to operational factors, Local regulations or causes beyond the control of BSEL. I hereby declare that the money paid to you by me was not or is not derived or obtained by illegal means, transactions or unlawful dealings. I further undertake that I have read, understood and agree with the following:

BRAC Saajan Exchange Limited (BSEL), an Authorised Payment Institution with registered business premises at BSEL House 160-162 Lozells road Birmingham B19 2SX is undertaking this transaction at my behest. Details of its Data Protection Officer are +44 (0) 121 515 4008, Email: [email protected]. I am consensually providing my personal data to BSEL for the purpose of effecting this money transfer as a necessary contractual pre-condition as well as a statutory requirement in line with the Money Laundering Regulations 2017 and the EU Wire Transfer Regulations II (EU 2015/847). I am thus obliged to provide this information failing which the money transfer will not be carried out. BSEL shall further inform me if it intends to use the information provided for any other purpose apart from direct marketing which it may carry on as a legitimate interest.
  3. The recipients of this personal data are BRAC Saajan Exchange Limited as a controller, its authorised staff and agent as well as other processors it may appoint for the purpose of this money transfer. This may include duly authorised and regulated processors in third countries with regard to the destination and pathway of the money transfer with or without an adequacy decision by the commission but with appropriate contractual safeguards to ensure the protection of my data rights in accordance with Article 46 of the General Data Protection Regulation and Article and Article 75 of the Data Protection Act 2018. The personal data provided by me will be stored by BSEL for a minimum of five years and a maximum of ten years with regard and subject to relevant provisions of article 40 of the Money Laundering Regulations 2017
  4. Where I do not have the above information already, upon request and satisfactory identification, BSEL shall confirm if my personal data is being processed and provide access to it along with relevant information and copies of such information except where such provision affects the rights and interests of others.
  5. The existence of my right to request for rectification of wrongful or incomplete information about me. The existence of my right to erasure of my personal data subject to Article 17 of the GDPR
  6. The existence of my right to restriction of processing of my personal data subject to Article 18 of the GDPR
  7. The existence of my right of recourse to the regulatory authorities namely the Information Commissioner’s Office (ICO) which can be reached on https://ico.org.uk/global/contact-us/ and the further right to seek judicial remedy against either BSEL or the regulatory authorities.
  8. The existence of automated decision-making, including profiling as a prerequisite for entering into this contract the results of which may inform BSEL’s contractual choice and the existence of my data portability rights subject to Article 20 of the GDPR
  9. Use of Credit Card: I understand that if I use a credit card for money transfer/remittance payment, my credit card issuer may treat this as a “cash advance” rather than a purchase transaction, and may impose additional fees and interest rates for the transaction. BRAC Saajan Exchange Limited is not responsible for any non-sufficient funds charges, chargeback fees, or other similar charges that might be imposed by my bank, credit card issuer or other providers. Further, BRAC Saajan Exchange Limited is not responsible in the event my designated recipient receives less than the sum remitted due to imposition of taxes/fees/charges by BRAC Saajan Exchange Limited’s processor/correspondent bank and/or the bank or financial institution of my recipient.
  10. That BSEL will provide information on action taken on a request for access to data, rectification, erasure, restriction of processing, data portability and objection within one month of receiving such request. This period may be extended by two months with reasons adduced by BSEL. I am also aware that I can register a complaint to BSEL through [email protected] or +44 (0) 121 515 4008 with further recourse to the financial ombudsman which can be contacted via https://www.financial-ombudsman.org.uk/consumer/complaints.html.
